What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant pays $500 to the Landlord on or before the 15th of each month from December 2021 to April 2022, then $1,000 per month from May 2022 to November 2022, and a final payment of $370.18 on or before December 15, 2022. The Tenant must also pay the full monthly rent for December 2021 by December 5, 2021 and the full monthly rent for January 2022 to December 2022 by the first of each month. If the Tenant fails to make any of these payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing will become payable with interest.
