What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective April 25, 2021. The Tenants must vacate the rental unit by that date. The Landlord owes the Tenants $2,097.90 from the rent deposit and interest, which the Landlord can offset with $61.15 per day in compensation starting April 15, 2021 until the Tenants move out. If the Tenants pay $1,032 by April 25, 2021, the eviction order will be void and the tenancy will continue.
