What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenants did not void by paying the arrears. Tenant ACS vacated the unit at the end of August 2020, while Tenant YG remained in possession.
The ruling
The tenancy is terminated effective February 28, 2021. The Tenants must pay $18,873.66 to the Landlords, which includes rent arrears, compensation, and charges, less the rent deposit and interest. The Tenants must also pay $88.77 per day for compensation starting January 21, 2021 until they move out. If the Tenants do not pay the full amount by February 28, 2021, they will owe interest starting March 1, 2021. If the unit is not vacated by February 28, 2021, the Landlords may file the order with the Sheriff for enforcement.
