What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served an N8 Notice of Termination on August 27, 2021, with a termination date of October 31, 2021. The Tenant's rent ledger showed numerous late rent payments over the past year.
The ruling
The Board granted relief from eviction subject to conditions. The Tenant must pay the monthly rent on or before the 1st day of each month from February 2022 to January 2023. If the Tenant fails to make any of these payments, the Landlord may apply to the Board within 30 days of the breach for an order terminating the tenancy and evicting the Tenant under s. 78 of the Act.
