What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant admitted he could not afford to pay the rent or outstanding arrears.

The ruling

The tenancy is terminated effective October 30, 2021. The Tenant must pay the Landlord $5,798.97 in rent arrears and compensation, plus $19.46 per day starting October 20, 2021 until the Tenant vacates. The Tenant must also pay $186 in application fees. If the Tenant pays $6,198 on or before October 30, 2021, the eviction order will be void and the Tenant can remain in the unit.
