What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlords served valid N4 and N8 notices, but the Tenant did not void the notices or attend the hearing.

The ruling

The tenancy was terminated effective February 5, 2023. The Tenant was ordered to pay $24,926.80 in rent arrears and application filing fees, less the rent deposit and interest owed. The Tenant was also ordered to pay daily compensation for use of the unit after the termination date. If the Tenant did not pay the full amount by February 5, 2023, the Landlords could file the order with the Court Enforcement Office to enforce the eviction.
