What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.
The ruling
The parties consented to the following order: 1) Tenant shall pay Landlord $8,186 for rent arrears up to March 31, 2023 and costs, in monthly installments of $700 from March 2023 to January 2024, with a final payment of $486 on February 15, 2024; 2) Tenant shall also pay new rent on time and in full until the arrears are paid; 3) If Tenant fails to make any payment, the full outstanding balance becomes immediately due and Landlord may apply for an order terminating the tenancy and evicting the Tenant.
