What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.
The ruling
The parties consented to the following order: 1) Tenant shall pay Landlord $8,186.00 for rent arrears up to March 31, 2023 and costs, in monthly installments of $700.00 from March 15, 2023 to January 15, 2024, with a final payment of $486.00 on February 15, 2024. 2) Tenant shall also pay new rent on time and in full as it comes due from April 1, 2023 to February 1, 2024, or until the arrears are paid in full, whichever is earlier. 3) If Tenant fails to make any one of the payments, the outstanding balance shall become immediately due and owing, and Landlord may apply to LTB for an order terminating the tenancy and evicting the Tenant.
