What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears.
The ruling
The Landlord's application to terminate the tenancy and evict the Tenant is denied, subject to the condition that the Tenant pays the Landlord $5,801.00 in arrears and costs. The Tenant shall pay $200.00 on the first Friday of each month for 28 consecutive months starting July 2021, and $201.00 on or before November 3, 2023. The Tenant shall also pay the lawful monthly rent on or before the first day of each month for 29 consecutive months starting July 2021. If the Tenant fails to make any of the payments, the outstanding balance shall become immediately due and owing, and the Landlord may apply to the Board for an order terminating the tenancy and evicting the Tenant.
