What happened

Landlord applied for an order requiring Tenant to pay the rent that the Tenant owes. The Tenant vacated the rental unit on January 31, 2021 without giving the proper 60-day notice. The Tenant had submitted evidence to the Board regarding various issues with the rental unit, including loud fridge noise, very loud bathroom fan noise, and the A/C not working.

The ruling

The Landlord's application is dismissed. The Tenant's motion to have the last month's rent deposit count towards the rent for January 2021 is granted due to the issues with the rental unit.
