What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on September 8, 2022, prior to the hearing date.

The ruling

The tenancy is terminated effective October 31, 2019. The Tenant must pay $2,840.04 to the Landlord, which includes rent arrears up to September 10, 2019, less the rent deposit and interest. The Tenant can void the order by paying $4,808.10 by September 30, 2019 or $5,731.40 by October 31, 2019.
