What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The Tribunal has granted the Landlords' application but has provided the Tenants with a payment plan to gradually pay off the rent arrears over the course of 15 months. The Tenants are ordered to pay $7,654 in arrears and costs, with a payment schedule of $500 per month from August 2022 to September 2023, with a final payment of $654 in October 2023. The Tenants must also continue to pay the monthly rent on time and in full during this period. If the Tenants fail to make any of the scheduled payments, the Landlords may apply for immediate termination of the tenancy without further notice.
