What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had informed the landlord that they intend to vacate the unit by March 31, 2023, prior to the hearing date.
The ruling
The tenancy is terminated unless the Tenants pay $4,002 by March 31, 2023 or $5,129 by April 7, 2023 to void the order and continue the tenancy. If the tenancy is terminated, the Tenants must pay $2,268.29 to the Landlord, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The Tenants must also pay $37.05 per day in compensation for use of the unit starting March 15, 2023 until they vacate.
