What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to their failure to meet a condition specified in the mediated settlement issued by the Board on November 27, 2019 with respect to a previous application.
The ruling
The tenancy is terminated effective February 7, 2021. The Tenants must pay the Landlord $9,545.35 (less any amount paid to the Landlord after the application was filed on December 15, 2020), which represents the rent owing up to January 27, 2021 and the costs related to the application fee for the previous application, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenants shall also pay the Landlord $27.95 per day for compensation for the use of the unit starting January 28, 2021 to the date the Tenants move out of the unit. If the Tenants do not pay the full amount owing by February 7, 2021, they will start to owe interest at 2.00% annually on the balance outstanding.
