What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The application was filed after serving valid Notices to End Tenancy Early for Non-payment of Rent (N4 Notice) and Persistent Late Payment (N8 Notice).

The ruling

The tenancy is terminated effective January 29, 2024. The Tenants must vacate the rental unit by this date. If they do not, the Landlord can file the order with the Sheriff to enforce the eviction. The Tenants owe $21,850.12 to the Landlord, which includes rent arrears and application fees, less the rent deposit and interest owed on the deposit. The Tenants must pay $1,000 bi-weekly starting February 1, 2024 until the arrears are paid in full. If they fail to make any of these payments, the full balance becomes due immediately and they will owe interest.
