What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to allegations of illegal drug activity in the rental unit. The Landlord also applied for an order for the Tenant to pay for damages to the property.

The ruling

The tenancy is terminated, and the Tenant must move out by February 12, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant must pay the Landlord $3,564.53, which represents compensation for the use of the unit from August 16, 2022 to January 18, 2023, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant will also owe the Landlord $37.81 per day for the use of the unit starting January 19, 2023 until the Tenant moves out. If the Tenant does not pay the full amount by February 12, 2023, the Tenant will owe interest at 5.00% annually on the outstanding balance.
