What happened

Landlord applied to terminate the tenancy and evict Tenant due to non-payment of rent and undue damage to the rental unit. The Landlord served a valid N4 Notice for non-payment of rent and an N5 Notice for undue damage. The Tenant contested the rent arrears claim and the allegations of undue damage, but did not attend the second hearing. The Landlord was granted an order for rent arrears and the cost of repairing the undue damage.

The ruling

The tenancy was terminated effective July 1, 2021 when the Tenant vacated the rental unit. The Tenant is ordered to pay the Landlord $5,039.07, which includes rent arrears, compensation for the period after the N4 notice, the cost of filing the application, and the cost to repair the undue damage to the rental unit.
