What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant is still in possession of the rental unit and has not paid the total rent owed from April 1, 2020 to December 31, 2020. The Landlord served a Notice of Termination effective April 30, 2020 due to the rent arrears.
The ruling
The Landlord's application to terminate the tenancy and evict the Tenant is denied, subject to the Tenant making the following payments: $1,590 by December 5, 2020, $5,000 by January 31, 2021, $400 per month from January to September 2021, and $297.17 by October 20, 2021. If the Tenant fails to make any of these payments, the Landlord can apply to the Board to terminate the tenancy and evict the Tenant.
