What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective December 7, 2020. The Tenant must move out by that date. The Landlord owes the Tenant $443.90 from the rent deposit and interest, but the Landlord can offset $34.11 per day for compensation starting November 27, 2020 and $175 for the application fee. The Tenant can void the order and continue the tenancy by paying $829.60 by November 30, 2020 or $1,867.22 by December 7, 2020.
