What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was in possession of the rental unit on the application date.

The ruling

The tenancy is terminated effective April 17, 2021 unless the Tenant pays $11,886 to void the order and continue the tenancy. If the Tenant does not pay the full amount owing by April 17, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement of the eviction. The Tenant is ordered to pay $11,850.62 in rent arrears and compensation, plus $29.59 per day starting April 7, 2021 until the Tenant vacates, and $186 in application filing costs.
