What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Rob Jarvis was still in possession of the rental unit on the hearing date, while the tenant Jill Jarvis had vacated the unit prior to the hearing.

The ruling

The tenancy is terminated unless the Tenants pay $15,001 by May 31, 2023 or $16,401 by June 11, 2023 to void the order. If the Tenants do not pay, they must vacate the unit by June 11, 2023 and pay the Landlord $12,569.92 plus daily compensation of $46.03 from May 10, 2023 until move-out. The Landlord's request for a repayment plan is denied, but a delayed eviction until June 11, 2023 is granted.
