What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective November 30, 2020. The Tenants must pay the Landlord $725 in rent arrears and $175 for the application filing fee. The Tenants' claim for $925 in landscaping costs is granted and will be set off against the arrears. If the Tenants provide proof of the last month's rent deposit, it will be applied to November 2020's rent provided they vacate by November 30, 2020.
