What happened
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation. The application was resolved by an order issued on consent of the parties on May 27, 2021. The Landlord later filed a request to clerically amend the order to include a provision allowing the Landlord recourse to section 78 of the Residential Tenancies Act, 2006 if the Tenant does not pay the on-going rent on time.
The ruling
The Tenant shall pay to the Landlord $6,500.00, which represents the amount of daily compensation owing up to July 31, 2021. If the Tenant does not pay the Landlord the full amount owing on or before October 1, 2021, the Tenant will start to owe simple interest calculated from October 2, 2021 at 2.00% annually on the balance outstanding.
