What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to meet conditions specified in a previous order (EAL-96174-21) issued on October 12, 2021. The Tenant failed to pay lawful rent on time for December 1, 2021, violating the condition to pay rent in full and on time from November 1, 2021, through October 1, 2022.

The ruling

The tenancy is terminated effective January 28, 2022. The Tenant must vacate the rental unit by this date. The Landlord is authorized to offset $28.24 per day for compensation for the use of the unit starting January 17, 2022, until the Tenant moves out. The previous order (EAL-96174-21) is cancelled. If the unit is not vacated by January 28, 2022, the Landlord may file this order with the Court Enforcement Office for eviction enforcement.
