What happened
Landlords applied to terminate the tenancy and evict the Tenant due to failure to pay rent as per a previous order. The Tenant filed a motion to set aside the order. The Landlords' representative and the Tenant attended the hearing.
The ruling
The Board granted the Tenant's motion to set aside the previous order and replaced it with a new order establishing an extended payment plan for the Tenant to pay the $8,586 in rent arrears. The Landlord's refusal to accept payment from the Tenant's ODSP worker to preserve the tenancy was found to be in bad faith, as the Landlord's true motivation was to renovate and sell the property.
