What happened

Tenants applied for an order determining that the Landlord failed to meet its maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The rental unit experienced water leakage from the unit above, resulting in damage to the bathroom ceiling, walls and other areas. The Landlord did not promptly address the issues despite the Tenants' requests.

The ruling

The Landlord is ordered to pay the Tenants a rent abatement of $2,310 for the period of December 2019 to July 2020, and $45 for the cost of filing the application, for a total of $2,355. The Landlord is also ordered to comply with the Property Standards Order and complete the required repairs by August 31, 2020. If the repairs are not completed by that date, the Landlord shall pay the Tenants an additional $330 per month in rent abatement until the work is done.
