What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had not vacated the rental unit by the hearing date.

The ruling

The tenancy is terminated unless the Tenant pays $28,986 by September 30, 2022 or $30,786 by October 8, 2022 to void the order and continue the tenancy. If the Tenant does not make the required payment, the Tenant must move out by October 8, 2022 and pay the Landlords $25,353.98 plus daily compensation of $59.18 from August 31, 2022 until the move-out date.
