What happened

The landlord applied for an order to terminate the tenancy and evict the tenants due to their failure to pay rent as ordered in a previous LTB order. The tenants had paid some of the arrears but not the full amount.

The ruling

The tenancy is terminated effective October 29, 2021. The tenants must pay the landlord $3,428.36, which includes rent arrears up to September 30, 2021 and costs from the previous application, less the rent deposit and interest owed on the deposit. The tenants must also pay $44.68 per day in compensation for use of the unit starting October 1, 2021 until they move out. If the full amount is not paid by October 29, 2021, the tenants will owe interest at 2% annually on the outstanding balance.
