What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant makes the following payments to the Landlord: $121 on June 10, 2021 (costs), $121 on July 10, 2021 (costs and arrears), $121 on August 10, 2021 (arrears), $121 on September 10, 2021 (arrears), and $80 on October 10, 2021 (balance of arrears). The Tenant shall also pay the Landlord the rent for the months of June 2021 up to and including October 2021 in full, on or before the tenth day of each corresponding month. If the Tenant fails to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and for the payment of any new arrears of rent and NSF charges.
