What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant may have vacated the rental unit, but it was insufficient for the adjudicator to conclude that the Tenant was no longer in possession.
The ruling
The tenancy is terminated effective January 24, 2021. The Tenant must pay the Landlord $11,360.71 in rent arrears and compensation, plus $40.34 per day starting January 14, 2021 until the Tenant vacates. The Tenant must also pay $175 in application fees. If the Tenant pays $12,171 on or before January 24, 2021, the eviction order will be void and the tenancy will continue.
