What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had not made any rent payments since April 15, 2015.
The ruling
The tenancy is terminated effective January 31, 2016. The Tenant must pay $19,114.91 to the Landlord, which includes rent arrears up to the termination date, compensation for use of the unit, and the application filing fee, less the rent deposit and interest. If the Tenant pays $22,570 by December 14, 2015 or $25,000 by January 31, 2016, the eviction order can be voided and the tenancy continued.
