What happened

Tenant applied for an order determining that Landlord substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of the Tenant's household and withheld or deliberately interfered with the reasonable supply of a vital service, care service, or food that the Landlord is obligated to supply under the tenancy agreement.

The ruling

The Landlord's failure to act to stop the noise entering the Tenant's rental unit on Sundays very early in the morning and late at night substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant. The Landlord shall be ordered to take steps to investigate and alleviate the noise coming from the downstairs church group on Sundays early in the morning and late at night.
