What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective October 6, 2020. The Tenant must vacate the rental unit by that date. The Landlord owes the Tenant $173.49 for the rent deposit and interest, but the Landlord can offset $47.50 per day for compensation starting September 26, 2020 and $190 for the application fee. The Tenant can void the eviction order by paying $1,684.08 by September 30, 2020 or $3,129.02 by October 6, 2020.
