Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent as per a previous LTB order. The Tenants did not meet the condition specified in the previous order to pay $1,186.00 towards arrears by October 10, 2022.

The ruling

The tenancy is terminated effective February 20, 2023. The Tenant must pay the Landlord $3,703.89 plus $52.60 per day for compensation for use of the unit starting February 10, 2023 until the Tenant moves out. If the Tenant does not pay the full amount by February 20, 2023, the Tenant will start to owe interest at 5% annually on the outstanding balance.
