What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant or Tenant's guests substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant.

The ruling

The tenancy is terminated effective December 31, 2023. The Tenant must move out by this date. If the unit is not vacated by January 1, 2024, the Landlord may file the order with the Court Enforcement Office for eviction. The Tenant shall pay the Landlord $186 for the application filing fee. The Landlord owes the Tenant $947.54 for the rent deposit and interest, which exceeds the amount the Landlord is entitled to. The Landlord may deduct $29.94 per day from this amount for compensation for the Tenant's use of the unit from October 19, 2023 until the Tenant moves out.
