What happened

Landlords applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Tenant's representative raised a preliminary issue that there was no tenancy relationship between the Landlords and the Tenant.

The ruling

The Act does not apply to the living arrangement between the parties, as they are required to share a bathroom and kitchen facility.
