What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and damage to the rental unit. The Tenant did not pay rent from April 2020 to April 2021, and the Landlord served a valid N4 notice. The Tenant also caused damage to the basement by plugging the drains with baby wipes, resulting in water damage.
The ruling
The tenancy is terminated effective May 29, 2021. The Tenant must pay the Landlord $17,567.29, which includes rent arrears, compensation, and the cost of filing the application, less the rent deposit and interest owed on the deposit. The Tenant must also pay $5,225.87 for the damage caused to the rental unit. If the Tenant does not vacate by May 29, 2021, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement.
