What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to meet a condition specified in a previous LTB order. The Tenant sought relief to set aside the order on the basis that the arrears were almost paid off.

The ruling

The previous order was set aside and replaced with a new order. The tenancy is terminated unless the Tenant pays $2,941.88 by 2023-02-28 to void the order. If the Tenant does not pay, they must move out by 2023-02-28 and pay $2,293.97 to the Landlord. The Tenant will also owe $21.53 per day for use of the unit starting 2023-03-01 if they do not vacate.
