What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenants pay $1,000 on March 20, 2021, $600 on the 20th of each month from April 2021 to March 2022, and the final payment of $373.01 on or before April 20, 2022. The Tenants must also pay the full monthly rent from April 2021 to April 2022 by the 1st of each month. If the Tenants fail to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenants, and for the payment of any new arrears of rent.
