What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation.

The ruling

The tenancy is terminated effective September 4, 2021. The Tenant must pay the Landlord $2,242.74 for the cost of repairing damage to the unit and $13,621.99 for compensation for the use of the unit from September 25, 2020 to August 4, 2021, less the rent deposit and interest. The Tenant must also pay $48.33 per day for compensation for the use of the unit from August 5, 2021 until the Tenant moves out. If the Tenant does not pay the full amount by September 4, 2021, the Tenant will owe interest at 2% annually on the outstanding balance.
