What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served a valid Notice of Termination effective September 4, 2020 due to rent arrears. The Tenants were in possession of the rental unit on the date the application was filed, but they had vacated the unit on June 22, 2021.

The ruling

The tenancy between the Landlord and the Tenants was terminated effective June 22, 2021, the date the Tenants vacated the rental unit. The Tenants are ordered to pay the Landlord $11,559.41, which includes rent arrears up to the termination date and the cost of filing the application. If the Tenants do not pay the full amount by November 15, 2021, they will start to owe interest at 2% annually on the outstanding balance.
