What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Tenants shall pay the Landlord $10,100.00 for rent arrears up to 2022-11-30 and $186.00 in costs, for a total of $10,286.00 less any payments made since the hearing. The Tenants shall pay $1,500.00 on or before the 20th of each month from 2022-12-20 to 2023-05-20, and $1,286.00 on or before 2023-06-20. The Tenants shall also pay new rent on time and in full as it comes due from 2022-12-01 to 2023-06-01 or until the arrears are paid, whichever is earlier. If the Tenants fail to make any one of the payments, the Landlord may apply to the LTB within 30 days for an order terminating the tenancy and evicting the Tenants.
