What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated effective September 12, 2022. The Tenant must vacate the unit by that date. If the unit is not vacated, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant must pay the Landlord $2,514.41, which includes compensation for use of the unit, the application filing fee, less the rent deposit and interest owed on the deposit. If the Tenant does not pay the full amount by September 12, 2022, they will owe interest at 3% annually on the outstanding balance.
