What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to meet a condition specified in the mediated settlement signed by the parties on April 05, 2022, with respect to a previous application.
The ruling
The tenancy is terminated effective March 31, 2023. The Tenant must pay the Landlord $1,983.63, which represents the rent owing up to March 20, 2023, and the cost of filing the application, less the rent deposit and interest owed on the deposit. The Tenant must also pay the Landlord $46.98 per day for compensation for use of the unit starting March 21, 2023 until the Tenant moves out. If the Tenant does not pay the full amount owing by March 31, 2023, the Tenant will start to owe interest at 5% annually on the outstanding balance.
