What happened

The Tenant gave the Landlord signed written notice to terminate the tenancy effective November 30, 2022. While the notice may have been defective as it was given on less than 60 days' notice, the Landlord accepted the Tenant's notice, and the parties agreed to end the tenancy on November 30, 2022.

The ruling

The tenancy between the Landlord and Tenant is terminated, and the Tenant must move out of the rental unit on or before January 23, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Tenant is not ordered to pay the Landlord's filing fee because the application was filed before the termination date.
