Landlord wins · 2016-08-24

Dispute
Harassment, Illegal Entry, Maintenance, Substantial Interference
Landlord
E.
Tenant
F., T.

What happened

Tenants filed an application alleging that the Landlord harassed them, entered the rental unit illegally, substantially interfered with their reasonable enjoyment, and withheld vital services. The Tenants claimed the Landlord entered illegally multiple times, called them names, sent frequent text messages about rent, maintained inadequate heat, failed to promptly fix hot water issues, and did not clean the unit before move-in. The Landlord denied all allegations and provided explanations for his actions.

The ruling

The Tenants' application was dismissed. The Board found insufficient evidence to support claims of harassment, illegal entry, or substantial interference by the Landlord. The Landlord's actions regarding maintenance issues were deemed reasonable and diligent.
