What happened
Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. Specifically, the Tenants claimed there was toxic black mold present in the basement, where the children's playroom was located, that the mold interfered with the Tenants' reasonable enjoyment of the basement, and that the issue was not properly rectified by the Landlord as required under the Act.
The ruling
The Landlord shall pay to the Tenant a rent abatement of $605.10, which shall be deducted from any arrears owing by the Tenants to the Landlord. If there are no outstanding arrears owing by the Tenants as of the date of this order, the Landlord shall pay the Tenants the full amount owing by August 31, 2021. If the Landlord does not pay the Tenants the full amount owing by August 31, 2021, the Landlord will owe interest.
