What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Tenants entered into an agreement to terminate the tenancy (the 'N11 Agreement'), but the Tenants did not move out by the termination date.

The ruling

The tenancy is terminated as of November 30, 2021. The Tenants must move out of the rental unit on or before November 30, 2021. The Tenants shall pay the Landlord $11,917.81 for compensation for the use of the unit from August 2, 2021 to October 21, 2021, and $197.26 per day for compensation for the use of the unit from October 22, 2021 to the date they move out of the unit. The Tenants shall also pay the Landlord $201.00 for the cost of filing the application. If the Tenants do not pay the full amount owing by November 30, 2021, they will start to owe interest at 2.00% annually on the balance outstanding.
