What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Tenants shall pay the Landlord $8,886.00 for arrears of rent up to January 31, 2023 and costs, in accordance with a payment plan. The Tenants shall also pay the Landlord new rent on time and in full as it comes due. If the Tenants fail to make any one of the payments, the outstanding balance shall become immediately due and owing and the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenants.
