What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent, persistent late payment, and substantial interference with the reasonable enjoyment of the Landlords. The Landlords also claimed NSF cheque charges and related administration charges.

The ruling

The tenancy is terminated as of March 1, 2020, the date the Tenants vacated the rental unit. The Tenants shall pay the Landlords $1,372.61, which represents the amount of rent owing and compensation up to March 1, 2020 and the total charges related to NSF cheques, less the rent deposit and interest the Landlords owe on the rent deposit. The Tenants shall also pay the Landlords $190.00 for the cost of filing the application. If the Tenants do not pay the full amount owing by February 20, 2021, they will start to owe simple interest at 2.00% annually on the balance outstanding.
